Judge Rules Tenant Stays After No Good Cause

Attorney Copoulos successfully defended against a Philadelphia Landlord-Tenant eviction in Municipal Court.  The landlord sought to evict the tenant for alleged noise and drug violations.  Tenant’s lease had expired.

Attorney Copoulos argued that a Section 8 lease cannot be terminated without good cause. After winning this point, Mr. Copoulos turned to the alleged violations.  It was established the tenant was a good and law abiding citizen. She had never been arrested. She was a single mother with a child. On cross examination, it was discovered that one of the so called “noise infractions” occurred when her daughter dropped a pot on the floor. The alleged drug issues were the product of bias. Tenants living above and below had complained over fifty times of alleged infractions committed by tenants!

At the conclusion of trial, the judge found no good cause to evict. The case was dismissed.
